Buyer Ticket Purchase Terms

Please read this agreement before buying tickets or registering for an event. It explains what your ticket is, how fees and refunds work, and the roles of the organizer and TicketSpark.

1. Parties to this agreement

This Ticket Purchase Agreement ("Agreement") is entered into between you (the "Buyer"), the event organizer who lists and produces the event (the "Organizer"), and TicketSpark (the "Platform"). You must accept this Agreement before completing a ticket purchase or registration.

TicketSpark is a ticketing technology and payment facilitation service. TicketSpark is not the event producer, promoter, venue operator, or seller of the event experience. The Organizer is the merchant of record for the event itself and is solely responsible for delivering the event as advertised.

2. Ticket purchase and license

A ticket is a revocable, limited license granted by the Organizer to attend a specific event at a specific date, time and location. Tickets are personal to the ticket holder and may not be resold above face value, bundled into commercial packages, or used for advertising, contests or sweepstakes without the Organizer's written permission.

Your order is confirmed only when payment is authorized and TicketSpark issues your ticket code(s). Order confirmations, QR codes and receipts are delivered to the email address you provide, so you are responsible for keeping that address accurate and accessible.

Each ticket carries a unique QR code that may be scanned only once. Duplicated, screenshotted, forwarded or altered codes may be refused at the door, and the first valid scan controls admission.

3. Pricing, fees and taxes

Ticket prices are set by the Organizer. Unless the Organizer chooses to absorb them, TicketSpark's service fee and payment processing fee are added to your order and are shown itemized before you pay and again on your emailed receipt.

Fees paid to TicketSpark compensate the Platform for ticketing technology, QR issuance, check-in tooling, customer support and payment processing, and are non-refundable once an order has been fulfilled, except where required by law or where an event is cancelled by the Organizer.

All amounts are charged in U.S. dollars. Where sales, entertainment, amusement or similar taxes apply, the Organizer is responsible for their calculation, collection and remittance.

4. Refunds, cancellations and postponements

All sales are final unless the Organizer publishes a more generous refund policy for the event. Refund policies are set and funded by the Organizer, not by TicketSpark.

If an event is cancelled and not rescheduled, you are entitled to a refund of the ticket face value from the Organizer. If an event is postponed or materially relocated, your ticket will normally be honored for the new date or location, and any refund remains subject to the Organizer's published policy.

TicketSpark may facilitate refunds on the Organizer's instruction and return funds through the original payment method. TicketSpark does not guarantee an Organizer's refund obligations and is not liable for an Organizer's failure to refund.

Duplicate charges, unauthorized transactions and technical payment errors should be reported to support@ticketspark.live within 60 days of the transaction so they can be investigated and corrected.

5. Admission and conduct

Admission is conditional on presenting a valid ticket code, complying with the venue's rules, and complying with any age, health, safety, security-screening or identification requirements published by the Organizer or venue.

The Organizer and venue may refuse entry to, or remove, any attendee whose conduct is unlawful, disruptive or unsafe, without refund.

You consent to being photographed, filmed or recorded as an attendee, and to the use of that footage in event and platform materials, unless the Organizer states otherwise.

6. Chargebacks and disputes

Before initiating a chargeback with your bank or card issuer, you agree to first contact the Organizer, and then TicketSpark, to resolve the issue. Chargebacks filed for orders that were validly fulfilled and scanned may be contested with the ticket, scan and delivery records held by the Platform.

Accounts associated with repeated fraudulent chargebacks may be suspended and future orders declined.

7. Data and communications

To fulfill your order, TicketSpark shares your name, email address, order contents and check-in status with the Organizer of the event you purchased from. The Organizer becomes an independent controller of that information and is responsible for handling it lawfully.

You will receive transactional messages relating to your order, such as receipts, ticket delivery and event-critical updates. These messages are required to deliver the service you purchased.

8. Limitation of liability

To the fullest extent permitted by law, TicketSpark's total liability arising from any order is limited to the amount of fees TicketSpark retained on that order. TicketSpark is not liable for the quality, safety, legality, cancellation or non-performance of any event, nor for indirect, incidental or consequential damages.

The Platform is provided on an "as is" and "as available" basis. TicketSpark does not warrant uninterrupted availability of the site, scanning tools or email delivery.

9. Changes, governing law and contact

TicketSpark may update this Agreement. The version you accepted at the time of purchase governs that purchase, and continued use of the Platform constitutes acceptance of the current version for future purchases.

This Agreement is governed by the laws of the State of Texas, without regard to conflict-of-law rules. Disputes with TicketSpark will be resolved in the state or federal courts located in Texas, unless applicable consumer law provides otherwise.
